Title Insurance/Title Opinions

All real estate has a legal history. Buyers and Lenders should be particularly interested in that history as it impacts the state of the title, and thus their rights in the property that they are purchasing or lending money on respectively. Upon review of that legal history, our attorney can provide an opinion on that current state of the title and issue a policy of title insurance insuring the current state of the title. Title insurance is a policy that offers protection against potential issues that may arise with a property’s title. These issues can include errors or omissions in public records, undisclosed liens, or previous owners’ claims on the property. Title insurance ensures that the property’s title is clear and that the current owner has the right to alienate (transfer) or encumber (mortgage) immovable property. All title policies in Louisiana are founded upon a Title Opinion by a licensed Louisiana attorney. Title opinions are legal opinions provided by our experienced attorneys, assessing the quality of a property’s title. These opinions will examine public records and evaluate the potential risks of purchasing or financing a property. If the attorney reaches the opinion that the title is “merchantable,” then a policy of title insurance may be written on the property, subject to certain exceptions and exclusions. Title Searches/Abstracting

The Title Search consists of searching for all documents filed of public record that impact and/or encumber a specific parcel or portion of real estate. These documents include, but are certainly not limited to acts of transfer (e.g. – sales, donations, exchanges), conventional and judicial mortgages, use and/or building restrictions, and servitudes. Collectively, these documents describe the legal history of the property, and ultimately bear upon and shape the current status of the title to the property. The purpose of this search is to identify any potential issues that may affect the transfer of ownership or the ability to obtain title insurance. Once the relevant documents have been compiled, a summary of the main points or key findings are summarized in the form of an abstract. This information is then used to help buyers and lenders make informed decisions about purchasing or financing property. Generally, an abstract will be compiled of those documents that have been filed within the last 36 years. 36 years is industry standard, and many risks associated with the title are prescribed (expired) by the passage of time. Title searches are limited to the public records. The Louisiana Public Records Doctrine provides that an instrument affecting immovable property is only effective against third persons from the time that it is filed for registry in the parish where the property is located. See Louisiana Civil Code articles 517, 1839, and 3338. This doctrine is sometimes described as a “negative doctrine” in that it negates the effectiveness of unrecorded instruments. With this rule, a third party can trust that the recorded acts of transfer or encumbrances in the public records are the only ones affecting the property, and may rely on the absence of any other documents from the public record that may negatively impact the property.

However, a wide variety of real estate transactions require specific documentation. Some examples include Bond for Deed Contracts, Private Financing documents such as promissory notes and mortgages, Powers of Attorney, exchanges, partitions, 1031 exchanges, boundary agreements, conventional servitudes such as rights of passage, counter letters, commercial and residential leases, construction contracts, and many others.

Notary Services

Notary services are services provided by a notary public who is a licensed official appointed by the State of Louisiana. Notaries provide the important role of certifying the signing of important documents. A notary public acts as an impartial witness to the signing of legal documents, verifying the identity of the signers, and ensuring that the signers understand that there are legal implications in the execution of those documents. Notary services may include notarizing various types of documents such as deeds, wills, powers of attorney, and affidavits. Notary services are important to ensure the authenticity and legality of important documents and can be required for a variety of legal and financial transactions. A document executed in the presence of a notary AND two witnesses, is given the status of “Authentic Act” in Louisiana. Authentic acts are important in Louisiana because they carry a presumption of truth, accuracy, and validity, and are considered to be strong evidence in court. This means that if a dispute arises over the contents of an authentic act, the burden of proof is on the party challenging the document to prove that it is false or invalid. Authentic Acts play a critical role in the legal system in Louisiana, providing a reliable and efficient way to create legally binding documents and establish the authenticity of important legal transactions.
